Welcome to Skicarrier. These Terms and Conditions govern the use of the website ski-carrier.com and all offers, orders and agreements resulting therefrom between Skicarrier and the Customer.
In these Terms and Conditions, the following terms are defined as:
2.1 These Terms and Conditions apply to every offer from Skicarrier and to every distance agreement concluded between Skicarrier and Customer.
2.2 Before the Agreement is concluded, the text of these Terms and Conditions will be made available to the Customer electronically in such a way that it can be easily stored by the Customer on a durable medium.
2.3 By placing an order on the Website and actively checking the declaration of acknowledgment and agreement with these Terms and Conditions, the Customer declares to agree with these terms.
2.4 These Terms and Conditions can only be deviated from if and insofar as Skicarrier has agreed to this in writing.
3.1 If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.
3.2 The offer of Products is without obligation. Skicarrier is entitled to modify and adjust the offer.
3.3 All offers contain a complete and accurate description of the Products offered. Images and specifications are indicative and may differ slightly from the delivered Product. Obvious mistakes or obvious errors in the offer do not bind Skicarrier.
3.4 If a product is unexpectedly no longer available after the Customer has placed an order, Skicarrier will inform the Customer as soon as possible. In this case, the Customer has the right to cancel the Agreement free of charge and Skicarrier will promptly refund any amounts already paid.
4.1 The Agreement is concluded at the moment of acceptance by the Customer of the offer and compliance with the conditions set thereby, including the acceptance of these Terms and Conditions.
4.2 If the Customer has accepted the offer electronically, Skicarrier will immediately confirm the receipt of the acceptance of the offer electronically by means of an order confirmation. As long as the receipt of this acceptance has not been confirmed by Skicarrier, the Customer can cancel the Agreement.
4.3 The order confirmation contains at least the following information: the order number, the ordered products, the prices, the shipping costs, the payment method, the delivery address and a link to the Terms and Conditions.
5.1 The prices stated on the Website are in euros, including VAT and excluding shipping costs, unless stated otherwise.
5.2 Full payment must be made directly during the ordering process. Skicarrier uses the Stripe payment service, which supports various payment methods, including credit card and iDEAL.
5.3 The Customer has the obligation to immediately report any inaccuracies in provided or stated payment details to Skicarrier.
6.1 Skicarrier will exercise the greatest possible care when receiving and executing orders for Products.
6.2 The risk of damage and/or loss of Products rests with Skicarrier until the moment of delivery to the Customer or a representative designated in advance and made known to Skicarrier.
6.3 The average delivery time is 3 working days. The maximum delivery time for Products in stock is 5 working days. If delivery is delayed, or if an order cannot be executed or can only be partially executed, the Customer will receive notification no later than 30 days after placing the order. In that case, the Customer has the right to cancel the Agreement free of charge and is entitled to a refund of any amounts already paid.
6.4 Delivery is provided by PostNL via mailbox package or regular post, depending on the nature and size of the Product.
6.5 If a delivered Product is damaged or does not conform to the order, the Customer must inform Skicarrier as soon as possible, but no later than 2 days after receipt, via info@ski-carrier.com. Skicarrier will, in consultation with the Customer, provide an appropriate solution (e.g. a replacement product or refund).
7.1 The Customer can cancel an Agreement regarding the purchase of a Product during a cooling-off period of at least 14 days without giving reasons. Skicarrier applies the return policy described in this document for this purpose.
7.2 During the cooling-off period, the Customer will handle the Product and packaging carefully. They will only unpack or use the Product to the extent necessary to assess whether they wish to keep the Product.
7.3 If the Customer exercises their right of withdrawal, they will return the Product with all supplied accessories and – if reasonably possible – in the original condition and packaging to Skicarrier, in accordance with the reasonable and clear instructions provided by Skicarrier (as described in the Return Policy).
7.4 The costs of return shipping are borne by the Customer.
7.5 Exceptions to the right of withdrawal are legally regulated and Skicarrier applies these if applicable, such as:

10.1 Complaints about the execution of the Agreement must be submitted to Skicarrier via info@ski-carrier.com within a reasonable time after the Customer has identified the defects, fully and clearly described.
10.2 Complaints submitted to Skicarrier will be answered within 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, Skicarrier will respond within 14 days with an acknowledgment of receipt and an indication of when the Customer can expect a more detailed response.
10.3 If the complaint cannot be resolved through mutual consultation, a dispute arises that is subject to the dispute resolution procedure.
10.4 For consumers in the EU, it is also possible to submit complaints via the European Commission's ODR platform, accessible via ec.europa.eu/consumers/odr.
11.1 All Agreements to which these Terms and Conditions apply are governed exclusively by Dutch law.
11.2 Disputes between the Customer and Skicarrier regarding the formation or execution of Agreements can, subject to the provisions below, be submitted to the competent court in the district of Oost-Brabant, location Den Bosch.
